Terms of Service

1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the Sina learning platform ("Sina", "the Service", "we", "us"), operated by Clustr. By creating an account, accessing the platform as a demo user, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 16 years old and able to form a binding contract to use Sina. If you are accessing the platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
3. The service
Sina provides AI-literacy baseline assessments, a structured 15-Star learning journey, practice exercises, and cohort-level analytics for administrators. Some features are currently provided in a demo or preview state and may change, be limited in functionality, or be discontinued at any time without notice.
4. Acceptable use
You agree not to:
- Use the Service in violation of any applicable law or regulation;
- Reverse engineer, scrape, or attempt to extract source code or data;
- Upload content that is unlawful, harmful, infringing, or misleading;
- Submit other people's personal data into prompts or activities without authorization;
- Interfere with the integrity or performance of the Service;
- Use the Service to train competing AI models or learning products.
5. Your content and AI inputs
You retain ownership of content you submit to Sina (including responses, prompts, and uploaded materials). You grant Clustr a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to operate, secure, and improve the Service for you and your organization. Aggregate, de-identified usage data may be used to improve Sina.
Do not submit confidential, regulated, or personally identifying information into AI prompts unless your organization has explicitly approved doing so.
6. AI-generated output
The Service uses third-party AI models (such as Microsoft Copilot, OpenAI, Anthropic, and Google) to generate responses, feedback, and suggestions. AI output can be inaccurate, incomplete, or biased. You are responsible for reviewing AI output before relying on it for any business or personal decision. Sina does not guarantee the accuracy of AI-generated content.
7. Organization-managed accounts
If your account was provisioned by an employer or partner organization, that organization administers your access, may view your progress and assessment results, and may suspend or remove your account. Your use is also subject to your organization's internal policies.
8. Intellectual property
Sina, including its course content, assessments, software, designs, and trademarks, is owned by Clustr and its licensors and is protected by intellectual property laws. You receive a limited, non-transferable, revocable license to access and use Sina for personal or internal business learning, and for no other purpose.
9. Fees
Demo and preview access is provided free of charge. Paid plans, when offered, are governed by a separate order form or subscription agreement between Clustr and the contracting organization.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service becomes commercially impractical. Sections that by their nature should survive termination (e.g., IP, disclaimers, liability limits) will survive.
11. Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Clustr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claims relating to the Service is limited to the greater of (a) the amounts you paid to Clustr for the Service in the 12 months before the claim, or (b) USD 100.
13. Indemnification
You agree to indemnify and hold harmless Clustr and its affiliates from any claims, damages, or expenses arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party right.
14. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of Sina after changes take effect constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which Clustr is established, without regard to its conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, except where local consumer-protection laws require otherwise.
